These Terms of Service ("Terms") govern your access to and use of the Staxa platform ("Service"), operated by Stackforge Labs ("we," "us," or "our"), a company registered in Jamaica. By creating an account or using the Service, you agree to be bound by these Terms.
1. Beta Program
The Service is currently in beta and is provided for evaluation and testing purposes. This means:
(a) The Service is under active development. Features may be incomplete, modified, or removed without notice.
(b) We do not guarantee uptime, availability, or performance. There is no service-level agreement (SLA) during the beta period.
(c) We may reset, migrate, or delete data, including deployed tenants, environment variables, and configuration, at any time during the beta period, with reasonable notice where practical.
(d) We reserve the right to end the beta program, limit access, or transition the Service to a generally available release at our discretion.
(e) Beta access is provided free of charge. We reserve the right to introduce paid plans in the future, at which point continued use may require a paid subscription.
2. Eligibility and Accounts
(a) You must be at least 18 years old to use the Service.
(b) You are responsible for maintaining the confidentiality of your account credentials, including any API keys issued through the Service. API key plaintext is displayed once at creation and is not stored by us. You are solely responsible for securing it.
(c) You agree to provide accurate information during registration and to keep your account information current.
(d) One account per person or legal entity. We may suspend or terminate duplicate or fraudulent accounts.
3. What the Service Does
Staxa is an API-first multi-tenant deployment platform. It provisions isolated application environments (including containers, databases, subdomains, and SSL certificates) on your behalf. You may interact with the Service through the web dashboard or the REST API.
4. Your Responsibilities
(a) Your Code and Data. You retain all ownership rights to the source code, container images, and data you deploy through the Service. We do not claim any intellectual property rights over your content.
(b) Acceptable Use. You agree not to use the Service to:
- Deploy applications that violate any applicable law or regulation.
- Host content that infringes third-party intellectual property rights.
- Distribute malware, conduct phishing, or engage in any form of cyberattack.
- Mine cryptocurrency or run computationally abusive workloads.
- Attempt to gain unauthorized access to other users' tenants, data, or platform infrastructure.
- Exceed the resource limits assigned to your account, or attempt to circumvent them.
- Resell, sublicense, or commercially redistribute access to the Service without our written consent.
(c) Environment Variables and Secrets. You are responsible for the content of any environment variables or secrets you store through the Service. Do not store credentials for systems you are not authorized to access.
5. Platform Intellectual Property
(a) The Service, including its source code, architecture, APIs, documentation, and branding, is the exclusive property of Stackforge Labs.
(b) These Terms do not grant you any license to use our trademarks, logos, or brand assets beyond what is necessary to use the Service as intended.
(c) Feedback, suggestions, or feature requests you provide may be used by us without obligation or compensation to you.
6. Data Handling
Your use of the Service is also governed by our Privacy Policy, which describes what data we collect, how we use it, and how we protect it. Key points relevant to these Terms:
(a) Environment variable values are encrypted at rest using AES-256-GCM. API keys are hashed and stored using SHA-256 with prefix-based lookup. We never store plaintext keys.
(b) Tenant databases are provisioned in isolated containers with generated credentials. You are responsible for any data stored within your tenant databases.
(c) During the beta period, we may access aggregated, non-identifying usage data (such as deployment counts, framework distribution, and error rates) to improve the Service.
7. Availability and Support
(a) The Service is provided on an "as-is" and "as-available" basis during the beta period.
(b) We may perform maintenance, deploy updates, or take the Service offline without prior notice.
(c) Support is provided on a best-effort basis. You may contact us at support@staxa.dev, but we do not guarantee response times during the beta period.
8. Account Suspension and Termination
(a) We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, or for any other reason with notice where practical.
(b) You may delete your account at any time. Upon deletion, we will make reasonable efforts to remove your data, tenants, and associated resources, though some data may persist in backups for a limited period.
(c) Upon termination, your right to access the Service ends immediately. We are not liable for any data loss resulting from termination.
9. Limitation of Liability
To the maximum extent permitted by law:
(a) The Service is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
(b) We are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
(c) Our total aggregate liability to you for any claims arising from the Service shall not exceed the amount you have paid us in the twelve months preceding the claim (which, during the free beta period, is zero).
(d) We are not responsible for data loss, downtime, deployment failures, or security breaches affecting your tenant applications, except to the extent caused by our gross negligence or willful misconduct.
10. Indemnification
You agree to indemnify and hold harmless Stackforge Labs, its officers, and agents from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third party's rights.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service dashboard. Your continued use of the Service after such notification constitutes acceptance of the updated Terms.
12. Governing Law and Disputes
(a) These Terms are governed by the laws of Jamaica.
(b) Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Jamaica.
(c) Before initiating any legal proceeding, both parties agree to attempt to resolve the dispute informally by contacting support@staxa.dev.
13. General
(a) If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.
(b) Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
(c) These Terms constitute the entire agreement between you and Stackforge Labs regarding the Service and supersede any prior agreements.
